FAMILY AND MATRIMONIAL MATTERS

Very often families can end up in dispute and the disputes can escalate into a major problem where the parties may desire to separate and even divorce.

Sometimes, there can be abuse in the home, physically and mentaly, and the abused partner does not necessarily know what their rights are.

Should there be abuse in the home environment, the government has brought into being what is referred to as the FAMILY VIOLENCE ACT which will allow the abused person the option of making a very quick appearance in the Magistrates Court in order to obtain what is called an INTERDICT restraining the other person from rendering any form of abuse or violence. However, this will only be in the form of what is called an INTERIM ORDER which means for a short period so as to give the other party time to come and defend the matter.

At the second Hearing, the Interim Order could be made a firm interdict.

Whether it be an Interim Order or other, the spouse against whom the order has been taken must abide by the Interdict or a warrant for arrest can be made.

If the internal strife within a marriage or a relationship continues, and the partners wish to get divorced, there is legislation which allows a relatively quick, easy and inexpensive divorce.

It is necessary if this happens that the parties meet together to arrive at an amicable conclusion and agreement to terminate the marriage which can be handed to the Magistrate in the divorce action.

It is similar to any agreement which the parties must accept.
